The applicant must sign either Form W-8BEN or Form W-9, or both if Form W-8BEN is used, and if form W-9 is used, the applicant must sign only as permitted by form W-9. If you are a U.S. legal resident and a requester gives you a form other than Form W-8BEN and you cannot file the form with your own form e.g. a U.S. passport , you must complete a separate application for a Form W-8BEN. If you are a permanent resident of the United States if you are also a foreign affiliate of “C” corp. and have a U.S. account number or taxpayer identification number, you must use Form W-8BEN as an alternative to form W-9, unless you are already using a Form W-9. If you have already used a Form W-9 to request for your foreign TIN, you can use a Form W-8BEN. There is no fee to use this alternative. The fee is a U.S. nonimmigrant fee of 75.00 per applicant. This nonimmigrant nonresident fee is calculated as 3/8 of the number of U.S. persons in the foreign country.  U.S. persons include persons who were resident in the United States on December 31, 2017, in the tax year ending on March 31, 2018. For purposes of determining the U.S. non-resident fee, a foreign affiliate of a “C” (Cerro Corp.) in the U.S. has no U.S. taxpayer identification number (TIN) except for limited purposes.
